Oklahoma State University Foundation (OSUF) has created an opportunity for donors wishing to avoid the complications of setting up their own private foundation which requires accounting and reporting to the Internal Revenue Service.

Creating a Donor-Advised Fund

Donors to OSUF may create a donor-advised fund to meet their charitable intentions by:

Discussing tax ramifications with your tax attorney or financial advisor to ensure that changes in the law affecting your financial stability are understood and taken into account with regard to charitable contributions;

Making your gift of cash, marketable securities, or mutual funds to OSUF of at least $25,000;

Working with a Director of Gift Planning to craft an endowment agreement specifying donor intent to distribute only income, or income and principal toward the projects or programs of a qualifying public charity. Your agreement will describe the frequency of pay-outs. OSUF requires that at least 25 percent of the corpus is dedicated to OSU purposes;

Specifying a named survivor trustee, if desired, or state the purpose for the fund at the donor’s death;

Understanding that the charity may consider donor recommendations for investment and choice of the beneficiaries of monies disbursed, but that a donor’s decision may be overruled by OSUF to ensure compliance with Internal Revenue Service laws governing 501 (c) (3) organizations, hence the term “advisory;”

Enjoying the opportunity to annually communicate with OSUF in the determination of eligible beneficiaries as defined by the IRS as well as the benefits that come from pooling your charitable gift with other like-minded donors’ funds. This way you may grow the corpus through managed investments; and collaborating with staff to fulfill your intentions, which may change from year to year.

Popularity

The popularity of donor-advised funds for individuals who receive many solicitations a year, or who have multiple charities they support, has increased in recent years because of their flexibility and the attractive feature that donors may be advisors every year in the choice of beneficiaries.
